The Department of Labor recently announced the final rule outlining specifying criteria for properly classifying a worker as an independent contractor under the Fair Labor Standards Act. This rule is effective March 11, 2024.
In this webinar, we will discuss the distinction between an employee and an independent contractor, and the potential employer liabilities for misclassification. We’ll focus on the DOL’s return to a totality-of-the-circumstances analysis of the economic reality test, applying it to common nonprofit jobs.
Note: This webinar will address the federal legal test, not state laws — which may be more restrictive.
