The Situation

An employee with ongoing productivity issues requested accommodation for health issues, and filed a complaint with an administrative body overseeing allegations of discrimination.

The nonprofit was found to have failed to meet the minimum standard of timing on the interactive process concerning the accommodation, so resolution action was requested by the other side.

The Resolution

Due to the finding of the administrative body, NIA was able to negotiate a good monetary settlement and obtain training classes through NIA’s ongoing webinars to meet the educational requirement.

These two actions prevented the nonprofit from facing future legal actions by the claimant and the administrative body.
