Employee Driving Her Own Car

The Situation

An employee of a nonprofit was using her own vehicle on agency business when she was involved in an at-fault accident.

The Resolution

The employee carried personal auto liability coverage, but her insurer denied coverage because the employee was using her vehicle for business purposes. NIA will often take this issue up with the primary carrier to challenge their coverage position. However, NIA will step in a primary for the handling of the claim, and has sought contribution after the settlement from the primary carrier with some success.

The nonprofit’s policy then became primary, providing first-dollar liability coverage for the at-fault accident.
