The California Fair Chance Act, also known as the “Ban-the-Box” law, prohibits pre-offer inquiries into criminal history and specifies the process for employers to follow when conducting criminal background checks.
Recent regulations specify the factors employers must consider when performing the mandated “individualized assessment” to determine whether the applicant’s criminal history is acceptable.
We will discuss the factors an employer can use to justify denying an applicant the position based on their criminal history, and the changes to the process required in these recent regulations.
