The Situation
The nonprofit faced numerous claims for copyright infringement, but insisted that as a nonprofit educational organization, they were allowed to use these materials without prior permission or paying licensing fees.
The Resolution
NIA educated the insured on copyright infringement by providing defense counsel’s opinion on why it is a violation to use someone else’s property without their explicit consent or paying licensing fees.
All nonprofits insured by NIA should be mindful of what they post on their websites and confirm they have authorization from the property’s owner and/or have paid a fee to use the material.
